These Terms and Conditions (“Terms”) apply to all consultancy services, artwork sales, artwork sourcing, and commissioning services provided by Haven and Hue Limited (“we”, “us”, “our”).
By booking our services, purchasing artwork, or engaging with us in any way, you (“you”, “the client”) agree to these Terms.
1. About Haven and Hue Limited
Haven and Hue Limited is a consultancy business providing:

Property staging consultancy (in-person and remote)
-
Artwork and sculpture consultancy (in-person and remote)
-
Sale of original artwork created by Haven and Hue
-
Sourcing and supply of artwork by third-party artists
-
Commissioning of bespoke artworks
2. Quotes, Packages and Scope of Work
We offer fixed-price consultancy packages, fixed-price project staging services, and fixed pricing for artwork.
Any quotation provided is based on the scope of work discussed at the time. If the scope changes, we reserve the right to revise the price accordingly.
Written guidance may include mood boards, examples of available artwork, and visual references sourced online.
3. Consultancy Services (Remote and In-Person)
Our consultancy services may include recommendations on:

Artwork placement and selection
-
Property staging suggestions
-
Interior styling guidance
-
Sourcing options for artwork and sculptures
Consultancy advice is based on the information provided by you, including measurements, photographs, preferences, and budgets. Results may vary depending on implementation, lighting, property condition, and client choices.
4. Artwork Sales and Retention of Title
All artwork sold by Haven and Hue Limited remains our property until full payment has been received.
You agree that until full payment is made:

You hold the artwork as a bailee for us.

You may not resell, pledge, or dispose of the artwork.

You are responsible for any loss, damage, or destruction of the artwork, even if accidental, while it is in your possession.
Risk in the artwork passes to you on delivery, but ownership only transfers once payment has been received in full.
5. Artwork Commissions and Third-Party Sourcing
Where we arrange a bespoke commission or source artwork on your behalf, we may charge a percentage commission, which will be agreed in writing before the order is confirmed.
Commissioned artworks may vary slightly from initial sketches, concepts, mood boards, or reference imagery. You accept that handmade and bespoke pieces may contain natural variations in colour, texture, and finish.
6. Payments and Invoicing
Unless otherwise agreed:
-
Payment is due within 14 days of delivery of artwork or completion of services.

Payments are typically collected via SumUp payment link.
-
All prices are provided in the agreed currency and include any agreed shipping/installation costs unless stated otherwise.
Late payments may result in delays to delivery, installation, or further work. We reserve the right to charge statutory interest and recovery costs on overdue invoices in line with the Late Payment of Commercial Debts (Interest) Act 1998.
7. Shipping, Delivery, and Installation
Shipping and installation arrangements will be agreed as part of the package price unless stated otherwise.
Unless otherwise agreed, risk in the artwork passes to you upon delivery.
If installation is included, you are responsible for ensuring safe access to the property and that walls and surfaces are suitable for installation.
8. Damage in Transit or While in Client Possession
If artwork arrives damaged, you must notify us within 2 days of receipt, including clear photographic evidence of:

the damage
-
the packaging
-
the delivery label (if applicable)
Where damage is confirmed, the resolution (repair, replacement, partial refund, or full refund) will be at the discretion of Haven and Hue Limited.
If artwork is damaged while in your possession before payment is completed, you are liable to pay for repair or replacement costs.
9. Cancellations and Rescheduling
Consultancy / Staging Services
You may cancel a booking within 7 days of the order being placed.
Rescheduling requests must be made at least 7 days before delivery or service is due.
Where cancellation occurs outside of the permitted timeframe, we reserve the right to charge for work already completed, including preparation time, travel, research, sourcing, and planning.
10. Returns and Refunds
As artworks are often bespoke and/or carefully sourced, returns are not automatically accepted.
Returns will only be considered by discussion and agreement with the client. Any discussions regarding a return must begin within 14 days of receipt of the artwork.
If a return is agreed:
-
the artwork must be returned in its original condition
-
the client may be responsible for return shipping and insurance unless otherwise agreed
-
we reserve the right to refuse a refund if the artwork is damaged after delivery
11. Client Responsibilities
You agree to:
-
provide accurate measurements, photos, and information where required
-
ensure property access is available at agreed times
-
ensure walls, fittings, and surfaces are suitable for installation
-
disclose any relevant property restrictions (listed buildings, fragile walls, rental restrictions, etc.)
We are not responsible for issues caused by inaccurate information provided by you.
12. Intellectual Property
All written guidance, mood boards, recommendations, designs, imagery compilations, and consultancy documents created by Haven and Hue Limited remain our intellectual property unless agreed otherwise in writing.
You may use provided materials for your personal project, but you may not reproduce, resell, publish, or distribute them commercially without our written consent.
13. Limitation of Liability
To the fullest extent permitted by law:

We are not liable for indirect or consequential losses, including loss of profit, business, or opportunity.

Our consultancy is advisory in nature and does not guarantee specific results or property sale outcomes.

Our total liability for any claim relating to services or artwork will not exceed the amount paid by you for the relevant service or artwork.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.
14. Force Majeure
We are not responsible for delays or failure to perform due to events beyond our reasonable control, including but not limited to courier delays, extreme weather, supply chain disruption, illness, travel restrictions, or acts of God.
15. Privacy
We handle personal information in accordance with our Privacy Policy, available on our website.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
